Attorney Profiles

OLIVER POLLAK earned his B.A. degree from the California State University at Los Angeles; his M.A. and Ph.D. (history) from UCLA, and his Law Degree (J.D.) from Creighton University in 1982.  He practices extensively in bankruptcy law and is a member of the Nebraska State and Iowa State Bar Associations.

DAVID HICKS earned his B.A. degree from the University of Nebraska at Omaha and his Law Degree (J.D.) from Creighton University Law School in 1982.  He practices extensively in both personal and business bankruptcy throughout Nebraska and Iowa.

Mr. Hicks has served as Chairman of the Bankruptcy Section of the Nebraska State Bar Association and Chairman of a Bar Section Committee to study and propose changes in exemption laws to the Nebraska State Legislature.  He served on the Board of Directors of a federally chartered Community Development Credit Union. 

Mr. Hicks has been a certified bankruptcy specialist by the American Board of Certification continuously since 1992. He is a member of the American Bankruptcy Institute, the National Association of Consumer Bankruptcy Attorneys, as well as the Omaha, the Nebraska State and Iowa State Bar Associations.

Consumer and Personal Bankruptcy. 
This includes representing individuals, married couples and families experiencing debt or other financial problems.  We handle the entire case, from beginning (creative pre-bankruptcy planning) to end (discharge). An extensive interview is done with the debtors regarding which assets they want to protect, which debts are problems, and information regarding their income and expenses.  A detailed explanation of the various bankruptcy options and how each would help the situation is provided.  Then, depending on the situation and the person’s goals, a Chapter 7, Chapter 11 or Chapter 13 bankruptcy is filed.  Utilizing the federal bankruptcy case number, we then protect the client from creditors and help them through the process, including any court appearances.  Upon completion of the case, the Debtor receives a discharge from the Court and the client can proceed with their fresh start.  Specific details regarding your personal situation can be obtained by calling Pollak & Hicks, P.C. at (402) 345-1717 or e-mailing DHicksLaw@aol.com.

 
Business Bankruptcy. 
This practice involves the protection of business entities experiencing cash flow problems, business downturns, or other financial setbacks. Debt Defense and Out of Court Workout.

Foreclosure Defense. 
This type of legal help is focused on helping people save their homes and businesses from mortgage or lien foreclosure.  Some types of mortgages and liens can be dealt with outside of bankruptcy by aggressively defending against the foreclosure.  At the very least, it can buy some extra time while a determination is made as to whether the creditor is correct about how much is owed and to develop a method to make payments on the appropriate amount.
